I have come to the conclusion that the law regarding agency and apparent authority, as explained in Chief Justice Moore’s special writing, does not support the conclusion reached by this Court in cases such as this one. Because I agree with Chief Justice Moore’s stated rationale as to why no arbitration agreement existed between Lorene S. Jones and Kindred Nursing Centers East, LLC, I respectfully dissent.
