- 1 WO 2 3 4 5 6 IN THE UNITED STATES DISTRICT COURT 7 FOR THE DISTRICT OF ARIZONA 8 9 Jerry Alfonso Ochoa, No. CV-17-03340-PHX-JAT 10 Petitioner, ORDER 11 v. 12 Charles Ryan, et al., 13 Respondents. 14 15 On March 15, 2021, the Court issue the following Order: 16 Pending before the Court is Petitioner’s third motion for relief under Federal Rule of Civil Procedure 60 (“Rule 60”). (Doc. 70). Alternatively, 17 Petitioner seeks leave to file a second or successive petition under 28 U.S.C. § 2254. (Id.). The Court will consider the request for Rule 60 relief. 18 Petitioner’s current filing is 129 pages. The middle of the filing appears to largely be copies of filings from Petitioner’s state court case. 19 Rule 60 has multiple subparts. Each subpart has its own legal standard for granting relief. In his 129 pages, the Court can find no reference to which 20 section of Rule 60 Petitioner is moving under, or how he qualifies for relief under any part of Rule 60. Instead, Petitioner advances an ineffective 21 assistance of counsel argument. (Doc. 70 at 3-17). Petitioner’s Petition in this case was denied because it was barred by 22 the Anti-Terrorism and Effective Death Penalty Act’s statute of limitations. (Doc. 58). The Court can find no reference to this fact in Petitioner’s 23 currently pending motion. Thus, the Court is unclear under what theory Petitioner now seeks to bring a claim of ineffective assistance of counsel. 24 For example, Rule 60(b)(1), “applies to ‘mistake, inadvertence, surprise, or excusable neglect,’ [and] permits a court to correct its own 25 inadvertence, mistakes of fact, Kingvision Pay–Per–View Ltd. v. Lake Alice Bar, 168 F.3d 347, 350 (9th Cir. 1999), or mistakes of law, Liberty Mut. Ins. 26 Co. v. E.E.O.C., 691 F.2d 438, 440–41 (9th Cir. 1982).” San Luis & Delta- Mendota Water Auth. v. U.S. Dep't of Interior, 624 F. Supp. 2d 1197, 1208 27 (E.D. Cal. 2009), aff'd sub nom. San Luis & Delta-Mendota Water Auth. v. United States, 672 F.3d 676 (9th Cir. 2012). Because Petitioner does not 28 argue for reconsideration of this Court’s prior order, the Court assumes Petitioner is not arguing mistake under Rule 60(b)(1). 1 By way of further example, Rule 60(b)(2) allows the Court to grant relief from a final judgment when there is “newly discovered evidence that, 2 with reasonable diligence, could not have been discovered in time to move for a new trial under Rule 59(b).” However, “[e]vidence in the possession 3 of the party before the judgment was rendered is not newly discovered.” Feature Realty, Inc. v. City of Spokane, 331 F.3d 1082, 1093 (9th Cir. 2003) 4 (internal quotations and citation omitted). In this case, it would appear Petitioner had all the information on which he now relies regarding his 5 counsel’s performance prior to this Court’s decision in March 2019. Moreover, for Petitioner to be entitled to relief under Rule 60(b)(1), 6 (2) or (3), he must have brought his motion within one year of the final judgment, which he did not. Fed. R. Civ. P. 60(c)(1). With respect to Rule 7 60(b)(4), (5) and (6), in addition to the fact that Petitioner made no argument as to how they would apply, the evidence and arguments Petitioner has 8 presented do no overcome the fact that his Petition in this case was barred by the statute of limitations. Accordingly, for all of these reasons, relief under 9 Rule 60 will be denied. Petitioner argues that a certificate of appealability should not be 10 required for him to appeal. (Doc. 70-2 at 24). A request to appeal without a certificate of appealability is more properly directed to the Court of Appeals. 11 This Court is required to determine whether a certificate of appealability should issue. See Lynch v. Blodgett, 999 F.2d 401, 402-03 (9th Cir. 1993). 12 This Court finds that Petitioner has failed to raise an issue of constitutional magnitude and, accordingly, will deny a certificate of appealability. 13 As indicated above, Petitioner seeks the alternative relief of leave to file a second or successive petition. This Court does not have authority to 14 grant leave to file a second or successive petition. Thus, this Court will refer this request to the Court of Appeals. See Ninth Circuit Rule 22-3(a)(3). 15 Accordingly, IT IS ORDERED that to the extent Doc. 70 seeks relief under Rule 16 60, it is denied. IT IS FURTHER ORDERED that a certificate of appealability is 17 denied. IT IS FURTHER ORDERED that to the extent Doc. 70 seeks leave 18 to file a second or successive petition, it is referred to the Ninth Circuit Court of Appeals, and the Clerk of the Court shall notify the Court of Appeals 19 accordingly. 20 (Doc. 71). 21 Petitioner now moves to reconsider the foregoing Order. (Doc. 72). This currently 22 pending motion for reconsideration is Petitioner’s fourth request for relief from judgment 23 in this case not including his appeal and his request to file a second or successive petition. 24 (See Docs. 60, 65, 70, and 72). 25 First, Petitioner argues that his Rule 60(b) motion (Doc. 70) should have been 26 deemed to be timely due to COVID-19. (Doc. 72 at 4). Preliminarily, while the Court 27 previously found that Petitioner did not file within one year of the judgment, as is required 28 under Federal Rule of Civil Procedure 60(b)(1)-60(b)(3), the Court nonetheless concluded 1 Petitioner also had not shown any basis for relief. 2 Moreover, judgment in this case was entered on March 13, 2019. (Doc. 59). 3 Petitioner fails to explain any restrictions in place from March 13, 2019 to March 12, 2020 4 that prevented him from timely filing his Rule 60 motion. Further, Petitioner’s suggestion 5 that he could not timely file up to March 12, 2020 is belied by the fact that he filed a motion 6 requesting a status update on April 9, 2020. (Doc. 68). Thus, the Court will not reconsider 7 the conclusion that Petitioner’s motion was not filed within one year of the judgment; and, 8 the Court finds Petitioner is not entitled to any tolling of this deadline. Finally, even if 9 Petitioner had made a colorable argument for tolling, “A court must not extend the time to 10 act under Rule[] … 60(b).” Fed. R. Civ. P. 6(b)(2). 11 Second, Petitioner argues that this Court erred in ruling on whether Petitioner should 12 receive a certificate of appealability to appeal. (Doc. 72 at 2). In other words, Petitioner 13 argues that no certificate of appealability determination is required on his Rule 60(b) 14 motion. This Court is not the proper forum to seek leave to appeal without a certificate of 15 appealability. As previously indicated, Petitioner should direct such a request to the Court 16 of Appeals. Thus, reconsideration on this basis is also denied. 17 Third, substantively, Petitioner references ineffective assistance of counsel and 18 Martinez v. Ryan, 566 U.S. 1 (2012). (Doc. 72 at 6). As indicated in this Court’s prior 19 orders, Petitioner’s Petition in this case was untimely under the Anti-Terrorism and 20 Effective Death Penalty Act’s statute of limitations. Martinez has no applicability to the 21 statute of limitations. Accordingly, the Court will not reconsider its prior order on this 22 basis. 23 Additionally, Petitioner appears to argue that a change in the law would entitle him 24 to relief regarding the search of his cell phone. (Doc. 72 at 7). However, the case Petitioner 25 cites is from 2014, well before Petitioner filed his Petition in this case in 2017. Thus, this 26 argument also does not provide a basis for relief under Rule 60(b) or for reconsideration of 27 this Court’s prior order. 28 Based on the foregoing, 1 IT IS ORDERED that Petitioner’s motion for reconsideration (Doc. 72) is denied. 2 IT IS FURTHER ORDERED that, to the extent a determination on a certificate of || appealability is required for the denial of a motion for reconsideration of the denial of a Rule 60(b) motion, a certificate of appealability is denied for the reasons stated in the 5 || March 15, 2021 Order. 6 Dated this 12th day of April, 2021. 7 8 ' James A.
