    v.
David WILLIAM; Mary Sue Terry, Respondents-Appellees.

    No. 91-7088.

    Decided Dec. 13, 1991.

Denrick Eric Brown, appellant pro se.

Mary Sue Terry, Attorney General, John H. McLees, Jr., Office of the Attorney General of Virginia, Richmond, Va., for appellees.

    E.D.Va.

    DISMISSED.

Before K.K. HALL and WILKINS, Circuit Judges, and BUTZNER, Senior Circuit Judge.

    OPINION

    PER CURIAM:

    1

Denrick Eric Brown seeks to appeal the district court's order refusing habeas corpus relief pursuant to 28 U.S.C. § 2254 (1988). Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we deny a certificate of probable cause to appeal and dismiss the appeal on the reasoning of the district court. Brown v. William, No. CA-90-468-3 (E.D.Va. Mar. 22, 1991; May 1, 1991). We also deny the Appellee's Motion to Dismiss the Appeal. We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

    2

    DISMISSED.
