28 U.S.C. § 2255(1988) motion. We have reviewed the record and the district court's opinion accepting the recommendation of the magis- trate judge and find no reversible error. Accordingly, we affirm on the reasoning of the district court. United States v. Smalls, Nos. CR-91-288-2; CA-94-3508-2-8 (D.S.C. Oct. 5, 1995). We deny Appel- lant's motion for counsel and dispense with oral argument because the facts and legal contentions are adequately presented in the ma- terials before the court and argument would not aid the decisional process. AFFIRMED 2
