Fitzgerald, Appellant Pro Se. Daniel Francis Izzo, LAW OFFICES OF MARK R. DYCIO, P.C., Fairfax, Virginia, for Appellee Jeffrey Mangeno. Unpublished opinions are not binding precedent in this circuit. 2 PER CURIAM: Daniel W. Fitzgerald appeals the district court’s order dismissing his complaint for failure to state a claim and as frivolous pursuant to 28 U.S.C. § 1915(e)(2)(B) (2012). We have reviewed the record and find no reversible error. Accordingly, we deny leave to proceed in forma pauperis and dismiss the appeal for the reasons stated by the district court. Fitzgerald v. Virginia, No. 1:18-cv-00758-AJT-TCB (E.D. Va. Aug. 23, 2018). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before this court and argument would not aid the decisional process. DISMISSED 3
