PER CURIAM: Thomas Ensminger appeals the district court’s judgment and order denying relief on his petition filed under
28 U.S.C.A. § 2254(West 1994 & Supp. 1998) and denying his motion for appointment of counsel. We have reviewed the record and the district court’s order and find no reversible error. Accordingly, we deny a certif- icate of appealability and dismiss the appeal on the reasoning of the district court. See Ensminger v. Trent, No. CA-97-113-2 (N.D.W. Va. Sept. 29, 1998). We dispense with oral argument be- cause the facts and legal contentions are adequately presented in the materials before the court and argument would not aid the decisional process. DISMISSED 2
