    John D. SIMPSON, Petitioner-Appellant,
    v.
Edward W. MURRAY; Attorney General of the Commonwealth of
    Virginia, Respondents-Appellees.

    No. 92-7128.

United States Court of Appeals, Fourth Circuit.

    Submitted May 11, 1993.
    Decided Dec. 22, 1993.

Appeal from the United States District Court for the Western District of Virginia, at Roanoke. Jackson L. Kiser, Chief District Judge. (CA-92-341-R)

John D. Simpson, appellant pro se.

Reneen Evat Hewlett, Office of the Attorney General of Virginia, Richmond, VA, for appellees.

    W.D.Va.

    DISMISSED.

Before WIDENER, PHILLIPS, and WILKINSON, Circuit Judges.

    OPINION

    PER CURIAM:

    1

John D. Simpson seeks to appeal the district court's order refusing habeas corpus relief pursuant to 28 U.S.C. Sec. 2254 (1988). Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we deny a certificate of probable cause to appeal and dismiss the appeal on the reasoning of the district court.* Simpson v. Murray, No. CA-92-341-R (W.D. Va. Oct. 1, 1992). We deny Simpson's motion for oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

    DISMISSED

    *

The district court dismissed the case. However, summary judgment should have been granted because matters outside the pleadings were considered
