321 F.3d 924, 926 (9th Cir. 2003) (per curiam). We review de novo, Midwaters Trawlers Coop. v. Dep’t of Commerce,
393 F.3d 994, 1002 (9th Cir. 2004), and we affirm. The only issue open on remand was whether Jackson was unable to bring a claim in state court because defendants allegedly denied him access to some of his legal materials. Jackson has not raised this issue on appeal, and thus it is waived. See McKay v. Ingleson,
558 F.3d 888, 981 n.5 (2009). Jackson’s remaining contentions are unpersuasive. AFFIRMED. 09-56157
