ORDER 13 SUPERIOR COURT OF CALIFORNIA, et al., 14 Defendants. 15 16 17 Plaintiff, a pretrial detainee1 housed at the Rio Cosumnes Correctional Facility and 18 proceeding pro se, filed a civil rights action pursuant to 42 U.S.C. § 1983, together with a request 19 for leave to proceed in forma pauperis pursuant to 28 U.S.C. § 1915. Plaintiff has not, however, 20 filed a certified copy of his inmate trust account statement for the six-month period immediately 21 preceding the filing of the complaint. See 28 U.S.C. § 1915(a)(2). Plaintiff will be provided the 22 opportunity to submit a certified copy of his inmate trust account statement.2 Failure to comply 23 with this order will result in a recommendation that this action be dismissed without prejudice. 24 In the alternative, plaintiff may seek to voluntarily dismiss this action. Because exhaustion of administrative remedies is required,* and must occur 3 | before filing an action in federal court, plaintiff may wish to voluntarily dismiss this action to 4 | avoid imposition of the $350.00 filing fee, as well as the further delay he will suffer should this 5 || case be dismissed because plaintiff failed to first exhaust his administrative remedies.> Such 6 | further delay would involve resolution of this action, the period required for plaintiff to exhaust 7 | his administrative remedies at the jail, and then plaintiff would be required to file a new action in 8 | federal court, incurring another $350.00 filing fee. 9 In accordance with the above, IT IS HEREBY ORDERED that plaintiff shall submit, 10 || within thirty days from the date of this order, a certified copy of his inmate trust account 11 || statement for the six-month period immediately preceding the filing of the complaint. Cal. Code Regs. tit. 15, § 1361. 19 * Plaintiff's claims challenging his conditions of confinement are subject to the Prison Litigation 20 | Reform Act (“PLRA”), 42 U.S.C. § 1997e(a). “The PLRA mandates that inmates exhaust all available administrative remedies before filing ‘any suit challenging prison [or jail] conditions,’ 21 including, but not limited to, suits under § 1983.” Albino v. Baca, 747 F.3d 1162, 1171 (9th Cir. 2014) (quoting Woodford v. Ngo, 548 U.S. 81, 85 (2006)). The Supreme Court has held that courts may not excuse an inmate’s failure to exhaust administrative remedies prior to bringing 23 || suit under the PLRA, even to take into account “special” circumstances. Ross v. Blake, 136 S.
