OBJECTIONS DUE WITHIN FOURTEEN DAYS 16 17 18 19 On September 29, 2020, the previously assigned magistrate judge screened plaintiff’s 20 complaint, found that it failed to state a claim, and granted plaintiff thirty days to file an amended 21 complaint. ECF No. 4. Plaintiff failed to timely file an amended complaint. Accordingly, on 22 November 17, 2020, plaintiff was ordered to show cause within thirty days why this action should 23 not be dismissed for failure to prosecute and failure to state a claim. ECF No. 6. Plaintiff was 24 warned that failure to respond to the court’s order could result in dismissal of this action. Id. at 2. 25 To date, plaintiff has not filed an amended complaint, nor otherwise responded to the court’s 26 November 17, 2020 order. 27 Accordingly, it is ORDERED that the Clerk of Court shall randomly assign a United 28 States District Judge to this case. 1 2 Further, it is RECOMMENDED that: 3 1. This action be dismissed without prejudice for failure to prosecute, failure to comply 4 | with court orders, and for failure to state a claim as set forth in the September 29, 2020 order. See 5 | ECF No. 4. 6 2. The Clerk of Court be directed to close the case. 7 These findings and recommendations are submitted to the United States District Judge 8 | assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(). Within fourteen days 9 | after being served with these findings and recommendations, any party may file written 10 | objections with the court and serve a copy on all parties. Such a document should be captioned 11 | “Objections to Magistrate Judge’s Findings and Recommendations.” Any response to the 12 | objections shall be served and filed within fourteen days after service of the objections. The 13 | parties are advised that failure to file objections within the specified time may waive the right to 14 || appeal the District Court’s order. Turner v.
