In the event he chose to file a complaint, plaintiff was also required to submit 19 and in forma pauperis application or the filing fee. Id. at 3. Plaintiff was cautioned that failure to 20 file a complaint would result in a recommendation that this action be dismissed. Id. The thirty- 21 day period has now expired, and plaintiff has not responded to the court’s order, filed a 22 complaint, or filed an application to proceed in forma pauperis or paid the filing fee. 23 Accordingly, IT IS HEREBY ORDERED that the Clerk of the Court is directed to assign 24 a district judge to this case. 25 IT IS FURTHER RECOMMENDED that this action be dismissed without prejudice. 26 These findings and recommendations are submitted to the United States District Judge 27 assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l). Within fourteen days 28 after being served with these findings and recommendations, plaintiff may file written objections 1 | with the court.
