(ECF No. 51) 12 13 A stipulation for voluntary dismissal of the entire action with prejudice has been filed by 14 | Plaintiff and Counter-Defendant, A.J. Rassamni; and by Defendants, Counter-Claimants, and 15 | Third-Party Plaintiffs Fresno Auto Spa Inc. and Stevan Matijevich. (ECF No. 51.) Thus, the 16 | case has ended and is dismissed with prejudice as to Defendant, Counter-Claimants, and Third- 17 | Party Plaintiffs Fresno Auto Spa Inc. and Stevan Matijevich. See Fed. R. Civ. P. 41(a)(1)(A); 18 | Wilson v. City of San Jose, 111 F.3d 688, 692 (9th Cir. 1997). Further, because Third-Party 19 | Defendant, Juan Ramirez, has not filed either an answer or a motion for summary judgment, 209 | the case has ended and is dismissed with prejudice as to Third-Party Defendant Juan Ramirez. 21 | Accordingly, the Clerk of the Court is respectfully directed to close this case. 2 As requested by the parties, the Court will retain jurisdiction over this matter for purposes 23 | of enforcing the terms of the settlement agreement referred to in the stipulation for voluntary 34 | dismissal.
