ORDER 14 DUANE SHELTON, et al., 15 Defendants. 16 17 Plaintiff, who is proceeding pro se, brings this civil action. Pending before the 18 Court is plaintiff’s request for leave to amend. See ECF No. 45. 19 The Federal Rules of Civil Procedure provide that a party may amend his or her 20 pleading once as a matter of course within 21 days of serving the pleading or, if the pleading is 21 one to which a responsive pleading is required, within 21 days after service of the responsive 22 pleading, see Fed. R. Civ. P. 15(a)(1)(A), or within 21 days after service of a motion under Rule 23 12(b), (e), or (f) of the rules, whichever time is earlier, see Fed. R. Civ. P. 15(a)(1)(B). In all 24 other situations, a party’s pleadings may only be amended upon leave of court or stipulation of all 25 the parties. See Fed. R. Civ. P. 15(a)(2). Where leave of court to amend is required and sought, 26 the court considers the following factors: (1) whether there is a reasonable relationship between 27 the original and amended pleadings; (2) whether the grant of leave to amend is in the interest of 28 judicial economy and will promote the speedy resolution of the entire controversy; (3) whether 1 | there was a delay in seeking leave to amend; (4) whether the grant of leave to amend would delay 2 | atrial on the merits of the original claim; and (5) whether the opposing party will be prejudiced 3 | by amendment. See Jackson v. Bank of Hawai’1, 902 F.2d 1385, 1387 (9th Cir. 1990). Leave to 4 | amend should be denied where the proposed amendment is frivolous. See DCD Programs, Ltd. v. 5 | Leighton, 833 F.2d 183, 186 (9th Cir. 1987). 6 This case currently proceeds against defendants Mel, Shelton, and Hatley on 7 | plaintiffs second amended complaint filed on June 17, 2019. See ECF No. 36. Defendant Mel 8 | has filed an answer. See ECF No. 37. Defendants Shelton and Hatley have filed a motion to 9 | dismiss, which to date is unopposed. See ECF No. 43. Because the docket reflects that plaintiff 10 | has already filed one amendment as of right, leave of court is required to amend again. In his 11 | current request for leave to amend, plaintiff has only provided the Court with what appears to be a 12 | proposed amended complaint but no briefing in support of leave to amend. Specifically, plaintiff 13 | has not made any showing relative to the factors outlined above.
