EMERSON, et al., (ECF No. 83) 14 Defendants. 15 16 17 Plaintiff Jerry Dillingham is a state prisoner proceeding pro se and in forma pauperis in 18 this civil rights action pursuant to 42 U.S.C. § 1983. 19 Currently before the Court is Plaintiff’s fifth motion for appointment of counsel, filed 20 August 21, 2020. 21 As Plaintiff was previously advised, he does not have a constitutional right to appointed 22 counsel in this action, Rand v. Rowland, 113 F.3d 1520, 1525 (9th Cir. 1997), and the Court cannot 23 require any attorney to represent plaintiff pursuant to 28 U.S.C. § 1915(e)(1), Mallard v. United 24 States District Court for the Southern District of Iowa, 490 U.S. 296, 298 (1989). However, in 25 certain exceptional circumstances the Court may request the voluntary assistance of counsel 26 pursuant to section 1915(e)(1). Rand, 113 F.3d at 1525. Without a reasonable method of securing 27 and compensating counsel, the court will seek volunteer counsel only in the most serious and 28 exceptional cases. In determining whether “exceptional circumstances exist, the district court must 4:40 °U □□ YY EOE SAD MUO OW POC OPEN e Oye ove 1 | evaluate both the likelihood of success on the merits [and] the ability of the [plaintiff] to articulate 2 | his claims pro se in light of the complexity of the legal issues involved.” Id. (internal quotation 3 | marks and citations omitted). 4 In the present case, the Court does not find the required exceptional circumstances. As with 5 | Plaintiffs prior motions for appointment of counsel, he contends that he is unable to litigate this 6 | action because he is illiterate, has mental disabilities, requires the assistance of another inmate to 7 | draft his documents, and is in the disability placement program. Plaintiff seeks appointment of 8 || counsel to assist him at the settlement conference which took place yesterday, August 25, 2020. 9 | However, the Court does not find the required exceptional circumstances. Even if it is assumed 10 | that Plaintiff is not well versed in the law and that he has made serious allegations which, if proved, 11 | would entitle him to relief, his case is not exceptional. Circumstances common to most prisoners, 12 | such as a lack of education or limited law library access, do not alone establish exceptional 13 | circumstances that would warrant a request for voluntary assistance of counsel. The legal issues 14 | present in this action are not complex. Further, Defendants just filed an answer in this case, and at 15 | this early stage of the proceedings, the Court cannot find that Plaintiff is likely to succeed on the 16 | merits. Further, there is no indication from the record that Plaintiff has been unable to adequately 17 || articulate claims and prosecute this action—whether alone or with inmate assistance. In addition, 18 | Plaintiff has failed to demonstrate that he could not meaningfully participate in the settlement 19 | conference without the assistance of counsel.
