Expert discovery is required to be 19 completed “in a timely manner in order to comply with the Court’s deadline for filing dispositive 20 motions.” (ECF No. 4.) 21 The parties in this case previously requested to modify the scheduling order on December 22 30, 2020 to allow for additional time to conduct fact discovery. (ECF No. 53.) On February 1, 23 2021, the parties then sought an extension of one month for initial expert disclosures and 24 supplemental expert disclosures. (ECF No. 55.) Plaintiffs sought to modify the scheduling order 25 on the limited issue of obtaining samples from the Sacramento County Coroner’s Office on 26 February 23, 2021. (ECF No. 58.) The motion has not yet been ruled on. 27 A scheduling order may only be modified upon a showing of good cause and by leave of 28 1 Court. Fed. R. Civ. Proc. 6(b)(1)(A); Johnson v. Mammoth Recreations, Inc., 975 F.2d 604, 609 2 (9th Cir. 1992). In considering whether a party moving for a schedule modification has good 3 cause, the Court primarily focuses on the diligence of the party seeking the modification. Johnson, 4 975 F.2d at 609. 5 The parties have worked diligently in litigating this matter. The parties have conducted 6 numerous depositions in addition to multiple sets of written discovery. The parties have also 7 exchanged expert reports and are conferring regarding depositions of experts. The parties also 8 attended a mediation on December 16, 2020. The parties continue to engage in settlement 9 discussions and have scheduled another half-day mediation for May 26, 2021. In order to 10 accommodate expert depositions and the currently scheduled mediation, the parties request the 11 dispositive motion deadline be moved from July 7, 2021 to August 11, 2021. As no trial date is 12 set, this extension will not delay trial. The extension will allow sufficient time for the mediation 13 to go forward, expert depositions to be taken, and transcripts of those depositions received in order 14 to prepare dispositive motions. 15 For these reasons, good cause exists to modify the dispositive motion deadline.
