ORDER AND FINDINGS AND RECOMMENDATIONS 14 W. PEREZ, et al., 15 Defendants. 16 17 Plaintiff is a state prisoner proceeding pro se with a civil rights action pursuant to 42 18 U.S.C. § 1983. Plaintiff claims that he was falsely found guilty of a rules violation in retaliation 19 for exercising his first amendment rights. 20 By order dated March 29, 2023, the court screened and dismissed the complaint for failure 21 to state a claim. (ECF No. 4.) Plaintiff was granted thirty days leave to file an amended 22 complaint and advised that failure to file an amended complaint would result in a 23 recommendation that this action be dismissed. (Id. at 12.) Those thirty days have passed, and 24 plaintiff has not filed an amended complaint, sought additional time to file an amended 25 complaint, or otherwise responded to the court’s order. Accordingly, the undersigned will 26 recommend that this action be dismissed for failure to prosecute and failure to comply with court 27 orders. 28 //// 1 For the foregoing reasons, the Clerk of the Court is ORDERED to randomly assign this 2 | action to a United States District Judge. 3 IT IS HEREBY RECOMMENDED that this action be dismissed without prejudice.
