The magistrate judge’s conclusions of law are 23 reviewed de novo. See Britt v. The findings and recommendations (ECF No. 3) are ADOPTED IN FULL; 3 2. Plaintiff's motion to proceed in forma pauperis (ECF No. 2) is DENIED as moot; 4 3. The action is DISMISSED for lack of subject matter jurisdiction; and 5 4.
