Under Rule 25 18 of the Federal Rules of Civil Procedure, an action must be dismissed if no motion for substitution 19 is filed within 90 days from the date a plaintiff’s death is suggested on the record. No motion for 20 substitution has been filed. 21 Accordingly, IT IS HEREBY ORDERED that: 22 1. Defendant’s July 14, 2023 motion to dismiss is denied as moot; and 23 2. The Clerk of the Court assign a district court judge to this case. 24 IT IS HEREBY RECOMMENDED that: 25 1. Defendant’s November 7, 2023 motion to dismiss pursuant to Federal Rule of Civil 26 Procedure 25 be granted; and. 27 2.
