JODOIN, et al., 15 Defendants. 16 17 By order filed September 6, 2022, the court dismissed plaintiff’s complaint and granted 18 leave to file an amended complaint. Plaintiff did not timely file an amended complaint. On March 19 21, 2023, the court ordered plaintiff to file an amended complaint within 30 days or show cause in 20 writing why this action should not be dismissed for failure to prosecute and failure to comply 21 with court orders. Plaintiff has not filed an amended complaint or otherwise responded to the 22 court’s order. 23 For the foregoing reasons, IT IS HEREBY ORDERED that the Clerk of the Court is 24 directed to assign a district judge to this case; and 25 IT IS RECOMMENDED that this action be dismissed without prejudice. See Local Rule 26 110; Fed. R. Civ. P. 41(b). 27 These findings and recommendations are submitted to the United States District Judge 28 assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l). Within fourteen days 1 | after being served with these findings and recommendations, plaintiff may file written objections 2 | with the court and serve a copy on all parties.
