R. Civ. P. 23 41(a)(1)(A)(ii); Wilson v. City of San Jose, 111 F.3d 688, 692 (9th Cir. 1997), and has been 24 dismissed with prejudice. 25 /// 26 /// 27 1 The Court notes that on December 22, 2023, the Court granted Plaintiff’s motion for attorneys’ fees and costs (ECF 28 No. 116) in the amount of $8,728.15 pursuant to the parties’ settlement agreement.
