ORDER AND FINDINGS AND RECOMMENDATIONS 14 RON DESANTIS, et al., 15 Defendants. 16 17 Plaintiff is a state prisoner, proceeding without counsel, with a civil rights action pursuant 18 to 42 U.S.C. § 1983. For the reasons stated herein, the undersigned recommends dismissal of this 19 action. 20 Preliminary Matters 21 On September 1, 2023, the undersigned dismissed plaintiff’s complaint with thirty days to 22 file an amended complaint. (ECF No. 8.) 23 On September 21, 2023, plaintiff filed a motion for an extension of time to file an 24 amended complaint. (ECF No. 18.) On September 25, 2023, plaintiff filed an amended 25 complaint. (ECF No. 19.) 26 On October 27, 2023, and November 17, 2023, plaintiff filed motions for extensions of 27 time to file a second amended complaint. (ECF No. 22, 23.) On November 30, 2023, plaintiff 28 filed a second amended complaint. (ECF No. 24.) 1 Good cause appearing, plaintiff’s motions for extension of time are granted. Plaintiff’s 2 second amended complaint is deemed timely filed. The undersigned herein screens plaintiff’s 3 second amended complaint. Fed. R. Civ. P. 15. 4 On September 11, 2023, plaintiff filed a motion to correct. (ECF No. 12.) In this motion, 5 plaintiff appears to allege that he did not consent to the jurisdiction of the undersigned. (Id.) 6 Court records reflect that the Honorable William B. Shubb is assigned to this action. Plaintiff’s 7 concerns raised in his September 11, 2023 motion are resolved by the assignment of District 8 Judge Shubb to this action. Accordingly, the undersigned deems plaintiff’s motion to correct 9 resolved. 10 Second Amended Complaint 11 Screening Standard 12 The court is required to screen complaints brought by prisoners seeking relief against a 13 governmental entity or officer or employee of a governmental entity. 28 U.S.C. § 1915A(a). The 14 court must dismiss a complaint or portion thereof if the prisoner raised claims that are legally 15 “frivolous or malicious,” that fail to state a claim upon which relief may be granted, or that seek 16 monetary relief from a defendant who is immune from such relief. 28 U.S.C. § 1915A(b)(1), (2). 17 A claim is legally frivolous when it lacks an arguable basis either in law or in fact. 18 Neitzke v. Williams, 490 U.S. 319, 325 (1989); Franklin v. Murphy, 745 F.2d 1221, 1227-28 (9th 19 Cir. 1984). The court may, therefore, dismiss a claim as frivolous when it is based on an 20 indisputably meritless legal theory or where the factual contentions are clearly baseless. Neitzke, 21 490 U.S. at 327. The critical inquiry is whether a constitutional claim, however inartfully 22 pleaded, has an arguable legal and factual basis. See Jackson v. Arizona, 885 F.2d 639, 640 (9th 23 Cir. 1989), superseded by statute as stated in Lopez v. Smith, 203 F.3d 1122, 1130-31 (9th Cir. 24 2000) (“[A] judge may dismiss [in forma pauperis] claims which are based on indisputably 25 meritless legal theories or whose factual contentions are clearly baseless.”); Franklin, 745 F.2d at 26 1227. 27 Rule 8(a)(2) of the Federal Rules of Civil Procedure “requires only ‘a short and plain 28 statement of the claim showing that the pleader is entitled to relief,’ in order to ‘give the 1 defendant fair notice of what the . . . claim is and the grounds upon which it rests.’” Bell Atlantic 2 Corp. v. Twombly, 550 U.S. 544, 555 (2007) (quoting Conley v. Gibson, 355 U.S. 41, 47 (1957)). 3 In order to survive dismissal for failure to state a claim, a complaint must contain more than “a 4 formulaic recitation of the elements of a cause of action;” it must contain factual allegations 5 sufficient “to raise a right to relief above the speculative level.” Bell Atlantic, 550 U.S. at 555. 6 However, “[s]pecific facts are not necessary; the statement [of facts] need only ‘give the 7 defendant fair notice of what the . . . claim is and the grounds upon which it rests.’” Erickson v. 8 Pardus, 551 U.S. 89, 93 (2007) (quoting Bell Atlantic, 550 U.S. at 555, citations and internal 9 quotations marks omitted). In reviewing a complaint under this standard, the court must accept as 10 true the allegations of the complaint in question, Erickson, 551 U.S. at 93, and construe the 11 pleading in the light most favorable to the plaintiff. Scheuer v. Rhodes, 416 U.S. 232, 236 12 (1974), overruled on other grounds, Davis v. Scherer, 468 U.S. 183 (1984). 13 Second Amended Complaint 14 Like the original complaint, the second amended complaint names as defendants Ron 15 DeSantis, Donald J. Trump, Marco Rubio and Hunter Biden. (ECF No. 24 at 2.) The second 16 amended complaint contains three claims for relief which are largely undecipherable and appear 17 to combine conclusory terms and unrelated phrases and concepts. For example, plaintiff’s first 18 claim, which is representative of all three claims, alleges: 19 Election Contest. Man is more disposed to suffer evils while evils are sufferable then to right themselves by abolishing the forms which 20 their accustomed. Whisked away by silent conspiracy. Policed into detention without trial to be tortured, i.e., the trap, in some cases 21 murdered. Jimmy Krueger, Minister of Justice. Outlawry! Bounded you gave me knowledge of freedom, silenced you taught me how to 22 speak! Davis the revolution. Call for action; revolt, Israel. It is their right, it is their duty to throw off such government & provide future 23 guards for their security. D.O.I. time apportioned. The defendants did to the plaintiff illicit cohabitation. Sic rights. Confidence game. 24 More disposed to suffer. Omerga, P.O.D., Autrie vie, Stealth factor. The Hatch Act, Autrie Vie & P.O.D., my mother’s estate (a weapon 25 of cruelty & tyranny). 370 Spanish Spur Fallbrook CA 90028, i.e., leze majesty! Equity a sovereign matter. Deprived. Scintilla of 26 evidence. Isaiah 59:5. Causation the Hatch Act. Blue print. Right now, no legitimate penological interest in mint. The Tower Cop web. 27 They hatch eggs & weave the spiders web & from those who eat their eggs dies & from that which is crushed a vipor breaks out. 28 Isaiah:59:5, sic. 1 | Cd. at 4.) 2 Like the original complaint, plaintiff's second amended complaint is incomprehensible, 3 || lacks substance and fails to identify how any named defendant violated plaintiffs federal 4 || statutory or constitutional rights. As written, the complaint fails to state a potentially cognizable 5 || federal claim. 6 The undersigned recommends that this action be dismissed because it is clear that plaintiff 7 || cannot cure the pleadings defects discussed above. Akhtar v. Mesa, 698 F.3d 1202, 1212 (9th 8 | Cir. 2012) (“A district court should not dismiss a pro se complaint without leave to amend unless 9 || ‘itis absolutely clear that the deficiencies of the complaint could not cured by amendment.’”) 10 || (quoting Schucker v. Rockwood, 846 F.2d 1202, 1203-04 (9th Cir. 1998) (per curiam)). 11 Accordingly, IT IS HEREBY ORDERED that: 12 1. Plaintiffs motion to correct (ECF No. 12) is deemed resolved; 13 2. Plaintiff's motions for extension of time (ECF Nos. 18, 22, 23) are granted; and 14 IT IS HEREBY RECOMMENDED that this action be dismissed. 15 These findings and recommendations are submitted to the United States District Judge 16 || assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(1). Within fourteen days 17 || after being served with these findings and recommendations, plaintiff may file written objections 18 || with the court and serve a copy on all parties. Such a document should be captioned 19 || “Objections to Magistrate Judge’s Findings and Recommendations.” Plaintiff is advised that 20 || failure to file objections within the specified time may waive the right to appeal the District 21 | Court’s order.
