Thirty days from that date have now passed, and 19 plaintiff has not filed an amended complaint. Instead, on January 21, 2022, plaintiff filed the 20 Notice of Amendment form attached to the January 13, 2022 order. (ECF No. 9.) Attached to the 21 Notice of Amendment form is a copy of the January 13, 2022 order. (Id.) 22 Based on plaintiff’s failure to file an amended complaint within thirty days of the January 23 13, 2022 order, the undersigned recommends that this action be dismissed. 24 Accordingly, IT IS HEREBY ORDERED that the Clerk of the Court shall appoint a 25 district judge to this action; and 26 IT IS HEREBY RECOMMENDED that this action be dismissed without prejudice. See 27 Local Rule 110; Fed. R. Civ.
