On November 28, 2023, 18 the undersigned issued an order to show cause no later than December 18, 2023 why this action 19 should not be dismissed for lack of jurisdiction. Plaintiff was advised that failure to allege a 20 proper basis for jurisdiction would result in a recommendation that this action be dismissed. The 21 deadline has passed, and plaintiff has not shown cause why this action should not be dismissed. 22 Accordingly, IT IS HEREBY RECOMMENDED that this action be dismissed for lack of 23 jurisdiction. 24 In light of these recommendations, IT IS ALSO HEREBY ORDERED that all pleading, 25 discovery, and motion practice in this action are STAYED pending resolution of the findings and 26 recommendations. With the exception of objections to the findings and recommendations and 27 any non-frivolous motions for emergency relief, the court will not entertain or respond to any 28 motions and other filings until the findings and recommendations are resolved. ] These findings and recommendations are submitted to the United States District Judge 2 || assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(1). Within fourteen days 3 || after being served with these findings and recommendations, plaintiff may file written objections 4 || with the court and serve a copy on all parties. Such a document should be captioned “Objections 5 || to Magistrate Judge’s Findings and Recommendations.” Plaintiff is advised that failure to file 6 || objections within the specified time may waive the right to appeal the District Court’s order. 7 || Martinez v.
