ORDER AND FINDINGS AND RECOMMENDATIONS 14 GOVERNOR OF THE STATE OF CALIFORNIA, et al., 15 Defendants. 16 17 On March 17, 2023, I ordered plaintiff to submit, within thirty days, either the $402 filing 18 fee or an application to proceed in forma pauperis. ECF No. 3. I also warned him that failure to 19 respond to the order would result in a recommendation that this action be dismissed. Id at 1-2. 20 Plaintiff did not comply with that order. On May 16, 2023, I ordered him to show cause why this 21 action should not be dismissed for failure to pay the filing fee, failure to prosecute, and failure to 22 comply with court orders. ECF No. 7. I directed plaintiff to either pay the filing fee or submit a 23 complete application to proceed in forma pauperis within twenty-one days. Id. Within fourteen days 6 | after being served with these findings and recommendations, any party may file written 7 | objections with the court and serve a copy on all parties. Such a document should be captioned 8 | “Objections to Magistrate Judge’s Findings and Recommendations.” Any response to the 9 | objections shall be served and filed within fourteen days after service of the objections. The 10 | parties are advised that failure to file objections within the specified time may waive the right to 11 appeal the District Court’s order. Turner v.
