This identifying information is contained within various agency 11 records and databases, some of which are in the possession, custody, and control of Defendant 12 and Defendant’s counsel. Defendant agrees to produce to Plaintiff unredacted records relating to 13 Plaintiff, and (where appropriate and allowable by law) third-parties, subject to entry of the 14 following protective order, in accordance with the Privacy Act of 1974, 5 U.S.C. § 552a, to which 15 the Parties have stipulated. 16 WHEREFORE, at the request of counsel for the Plaintiff and counsel for Defendant, 17 IT IS HEREBY ORDERED that in accordance with the terms of this Privacy Act 18 Protective Order, pursuant to 5 U.S.C. § 552a(b)(11), Defendant is authorized to release to 19 counsel for Plaintiff, and the Court in this case, discovery containing unredacted identifying 20 information of third-parties, without obtaining prior written consent of third parties whose names, 21 addresses, birth dates, and other identifying information may be present in such documents. Such 22 disclosure is subject to the following conditions: 23 1. The Parties agree that the terms of this Protective Order will govern the entirety of 24 any file, including but not limited to alien registration file, any law enforcement report, or any 25 other discovery that contains Privacy Act material, as well as any copies or summaries made 26 thereof and any information derived therefrom, including any materials that have been previously 27 produced in discovery or will be produced through any further discovery taken in this case. 28 1 2. To the extent that any documents or records to be provided by the federal 2 government contain third-party names, addresses, birth dates, or any other identifying information 3 (i.e., information the use of which would allow the identification of the person to whom the 4 information relates), such identifying information shall be deemed confidential (in the ordinary 5 sense) and protected by this Protective Order. All such Privacy Act information is subject to this 6 Protective Order and may be used solely for purposes of this litigation. 7 3. Counsel for Defendants shall designate documents containing confidential 8 information as confidential by placing the word “COVERED BY PROTECTIVE ORDER” or the 9 following label (or a substantial equivalent) on them or on any copies thereof, or any cover sheets 10 thereon: 11 PROTECTED 12 THIS DOCUMENT IS SUBJECT TO A COURT ORDER IN HUITRON REGALADO v. 13 BLINKEN (2:22-cv-02104-DB). THIS DOCUMENT/VIDEO/DIGITAL RECORD AND ITS 14 CONTENTS SHALL NOT BE USED, SHOWN OR DISTRIBUTED EXCEPT AS PROVIDED 15 IN THE PROTECTIVE ORDER. 16 4. Protected information may be disclosed only to the following persons and only to 17 the extent necessary for the prosecution of this action: 18 A. Counsel for Plaintiff, Plaintiff, counsel for Defendant, Defendant and/or its 19 agents, and any support staff of such counsel assisting in this action; 20 B. The Court and its personnel; 21 C. Court reporters, translators, and other litigation support personnel; 22 D. Individuals whose testimony is contemplated or actually taken in this 23 action, but only to the extent necessary to elicit testimony concerning the 24 subject matter of information or records produced subject to this Protective 25 Order; 26 E. Expert witnesses or consultants retained by Plaintiff or Defendant; 27 F. The author of the document or the original source of the information; and 28 G. Any Court of Appeals and its personnel, in the event of an appeal. 1 5. Redactions permitted. Nothing, however, in this Stipulated Protective Order shall 2 be deemed to preclude the parties from redacting from documents subject to this Order, where 3 applicable, information protected by (a) attorney-work product, trial preparation material, or the 4 attorney-client privilege; (b) deliberative process privilege; (c) the governmental privilege against 5 disclosure of information which could threaten the lives and safety of governmental personnel 6 and their families, interfere with open investigations or prosecutions, or reveal confidential law 7 enforcement techniques or confidential sources; or (d) any other applicable privilege. Nothing in 8 this Stipulated Protective Order shall be deemed to preclude the parties from redacting from 9 documents subject to this Order, where applicable, information relating to law enforcement 10 deliberations and information about individuals not a party to this litigation and that are unrelated 11 to the issues in this litigation. 12 6. Upon the signing of this Order by the Court, redactions made by counsel, if any, 13 to the documents marked “COVERED BY PROTECTIVE ORDER” will not be made for the 14 purpose of protecting the privacy of third parties who may be identified in the discovered material. 15 Opposing counsel reserves the right to file a motion to compel for any redacted information. 16 7. All persons listed in Paragraph 4(A) above to whom identifying information is 17 disclosed are hereby prohibited from disclosing to, or otherwise discussing with, any person other 18 than those listed in 4(B)-(G) above, any confidential information, except as provided in this 19 Protective Order. 20 8. All persons listed in Paragraphs 4(D) and (E) above, to whom identifying 21 information is disclosed, shall first be required to read the terms of this Protective Order and sign 22 a copy of the Acknowledgment of Protective Order form, attached hereto as Exhibit A, agreeing 23 to be bound thereby. The signed Acknowledgment forms shall be maintained by counsel for 24 Plaintiff or counsel for Defendant. 25 9. A party that seeks to include materials subject to this Order in a filing shall first 26 request that the filing be made under seal, in accordance with Local Rule 141, unless a release is 27 obtained from the third-party individual to whom the materials pertain, authorizing the disclosure 28 of such information. 1 10. To the extent that third-party identifying information is discussed in the course of 2 a deposition, such confidential information must be designated as such by so indicating on the 3 record at the deposition, and the Plaintiff or Defendant shall request that the relevant portions of 4 the deposition transcript be filed under seal, in accordance with Local Rule 141, unless a release 5 is obtained from the individual to whom the identifying information pertains, authorizing the 6 disclosure of such information. 7 11. No protected documents or information shall be used at any hearing, trial or 8 appellate proceeding in this action, unless provision shall be made for exclusion of the public or 9 unless some other reasonable provision to protect confidentiality has been made. Where protected 10 documents or information is used at a hearing, trial or appellate proceeding in this action, the 11 Plaintiff or Defendant shall request that the appropriate portion of the court transcript be placed 12 under seal in accordance with Local Rule 141. Such a request shall be limited to those portions 13 of the transcript the sealing of which is reasonably necessary to preserve the confidentiality of 14 documents, as well as copies or summaries made thereof and any information derived therefrom, 15 which are subject to the terms of this Protective Order. 16 12. Due to the highly sensitive nature of information regarding third parties that may 17 be produced by Defendant, such protected documents or information shall not be used to contact 18 or attempt to contact third-parties named in the redacted documents for any purpose, absent the 19 express authorization of the undersigned counsel. 20 13. Inadvertent disclosure of any document or other information during discovery in 21 this action shall be without prejudice to any claims that such material is confidential, privileged, 22 or otherwise protected from discovery within the meaning of Federal Rule of Civil Procedure 26, 23 and no party to this Protective Order shall be held to have waived any rights by such inadvertent 24 disclosure. Any document or information so produced and subject to a subsequent claim of 25 privilege, work product or other protection, including protection under this Protective Order, shall 26 be returned immediately to the appropriate party, and such document or information shall not be 27 introduced into evidence in this or any other proceeding by any person without either (i) the 28 consent of said party, or (ii) Order of the Court; nor will such document or information be subject 1 to production (other than in camera) in any proceeding by virtue of the fact that it was 2 inadvertently produced in this proceeding. 3 14. Within thirty (30) days of the final conclusion of this litigation, including any 4 appeals, counsel for Plaintiff or Defendant shall collect all documents produced pursuant to this 5 Protective Order that contain third-party identifying information, as well as any copies thereof, 6 or any information and notes derived therefrom, and shall return such documents to counsel for 7 Plaintiff or Defendant pursuant to the terms of this Protective Order. Alternatively, counsel for 8 Plaintiff or Defendant shall destroy said documents by shredding them and provide counsel for 9 Plaintiff or Defendant with verification of destruction within thirty (30) days of the final 10 conclusion of this litigation, including any appeals. 11 15. Agreement to this Protective Order does not waive any rights of any party to assert 12 a claim of privilege as to these or similar documents. 13 16. Nothing in this agreement shall be deemed to restrict in any manner the use by any 14 party of its own documents or materials. 15 17. Nothing in this agreement shall affect the right of any party to seek additional 16 protection against the disclosure of documents or materials. 17 18. Any party may apply to this Court at any time, upon proper notice, for a 18 modification of this Protective Order with respect to the handling or designation of any document 19 or for any other purpose. 20 19. This Order shall be binding upon any present and future party to the HUITRON 21 REGALADO v. BLINKEN (2:22-cv-02104-DB) litigation. 22 20. This Order shall be effective and enforceable upon its signature by counsel and by 23 the Court. 24 //// 25 //// 26 //// 27 //// 28 //// 1 ORDER 2 Pursuant to the parties’ stipulation, IT IS SO ORDERED. 3 IT IS FURTHER ORDERED THAT: 4 1. Requests to seal documents shall be made by motion before the same judge who will 5 decide the matter related to that request to seal. 6 2. The designation of documents (including transcripts of testimony) as confidential 7 pursuant to this order does not automatically entitle the parties to file such a document with the 8 court under seal. Parties are advised that any request to seal documents in this district is governed 9 by Local Rule 141. In brief, Local Rule 141 provides that documents may only be sealed by a 10 written order of the court after a specific request to seal has been made. L.R. 141(a). However, a 11 mere request to seal is not enough under the local rules. In particular, Local Rule 141(b) requires 12 that “[t]he ‘Request to Seal Documents’ shall set forth the statutory or other authority for sealing, 13 the requested duration, the identity, by name or category, of persons to be permitted access to the 14 document, and all relevant information.” L.R. 141(b). 15 3. A request to seal material must normally meet the high threshold of showing that 16 “compelling reasons” support secrecy; however, where the material is, at most, “tangentially 17 related” to the merits of a case, the request to seal may be granted on a showing of “good cause.” 18 Ctr. for Auto Safety v. Chrysler Grp., LLC, 809 F.3d 1092, 1096-1102 (9th Cir. 2016); Kamakana 19 v. City and County of Honolulu, 447 F.3d 1172, 1178-80 (9th Cir. 2006). 20 4. Nothing in this order shall limit the testimony of parties or non-parties, or the use of 21 certain documents, at any court hearing or trial – such determinations will only be made by the 22 court at the hearing or trial, or upon an appropriate motion. 23 5. With respect to motions regarding any disputes concerning this protective order which 24 the parties cannot informally resolve, the parties shall follow the procedures outlined in Local Rule 25 251. Absent a showing of good cause, the court will not hear discovery disputes on an ex parte 26 basis or on shortened time. 27 6. The parties may not modify the terms of this Protective Order without the court’s 28 approval. If the parties agree to a potential modification, they shall submit a stipulation and 1 proposed order for the court’s consideration. 2 7. Pursuant to Local Rule 141.1(f), the court will not retain jurisdiction over enforcement 3 of the terms of this Protective Order after the action is terminated. 4 8.
