ORDER AND 14 WILLIAMSON, FINDINGS AND RECOMMENDATIONS 15 Defendant. 16 17 18 Plaintiff, a state prisoner, filed a civil rights action pursuant to 42 U.S.C. § 1983 on 19 August 8, 2022. On September 16, 2022, plaintiff was granted an extension of time of 30 days to 20 either pay the required filing fee of $350.00 plus the $52.00 administrative fee, or to file a motion 21 to proceed in forma pauperis.1 On October 13, 2002, plaintiff filed a request for copies in which 22 plaintiff stated he had lost paperwork in a facility transfer was still “in need of more time.”2 (ECF 23 No. 5.) Still, plaintiff has not submitted a motion to proceed in forma pauperis, has not paid the 3 | filing fee, and has not otherwise responded to the court’s September 16, 2022 order. 4 For the reasons set forth above, IT IS HEREBY ORDERED that the Clerk shall assign a 5 | district judge to this case. 6 In addition, IT IS HEREBY RECOMMENDED that this action be dismissed without 7 | prejudice. See Local Rule 110; Fed. R. Civ. P. 41(b). 8 These findings and recommendations are submitted to the United States District Judge 9 | assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(1). Within fourteen after 10 | being served with these findings and recommendations, plaintiff may file written objections with 11 || the court. The document should be captioned “Objections to Magistrate Judge’s Findings and 12 | Recommendations.” Plaintiff is advised that failure to file objections within the specified time 13 | waives the right to appeal the District Court’s order.
