(ECF No. 32.) 14 COMMISSIONER OF SOCIAL SECURITY, 15 Defendant. 16 17 On June 11, 2020, the undersigned recommended the court grant plaintiff’s motion to 18 remand the case under to sentence six of 42 U.S.C. § 405(g).1 (ECF No. 26.) The assigned 19 district judge adopted the findings and recommendations and remanded for further proceedings. 20 (ECF No. 27.) The parties stipulated to an award of fees and costs under the Equal Access to 21 Justice Act (“EAJA”). (ECF Nos. 30-31.) On remand, an administrative law judge determined 22 plaintiff had been disabled since May 2016 and awarded past benefits. (See ECF No. 32-2.) 23 Plaintiff’s counsel now moves for attorney’s fees under 42 U.S.C. § 406(b), seeking an award of 24 $19,560.00, or approximately 17% of plaintiff’s past due benefits. (ECF No. 32.) 25 For the reasons that follow, the undersigned recommends the motion for attorney’s fees 26 under 42 U.S.C. § 406(b) be granted. 27 1 This case was referred to the undersigned by Local Rule 302(c)(15). Local Rule 304. 1 DISCUSSION 2 Title 42 U.S.C. § 406(b) provides in relevant part: 3 Whenever a court renders a judgment favorable to a claimant under this subchapter who was represented before the court by an 4 attorney, the court may determine and allow as part of its judgment a reasonable fee for such representation, not in excess of 25 5 percent of the total of the past-due benefits to which the claimant is entitled by reason of such judgment, and the Commissioner of 6 Social Security may. . . certify the amount of such fee for payment to such attorney out of, and not in addition to, the amount of such 7 past-due benefits. In case of any such judgment, no other fee may be payable or certified for payment for such representation except 8 as provided in this paragraph. 9 42 U.S.C. § 406(b)(1)(A). The Commissioner typically does not act as an adversary, but “plays a 10 part in the fee determination resembling that of a trustee for the claimants.” Gisbrecht v. 11 Barnhart, 535 U.S. 789, 798 n.6 (2002). Thus, “[b]ecause the [Commissioner] has no direct 12 interest in how much of the award goes to counsel and how much to the disabled person, the 13 district court has an affirmative duty to assure that the reasonableness of the fee is established.” 14 Crawford v. Astrue, 586 F.3d 1142, 1149 (9th Cir. 2009) (en banc). 15 In reviewing the fee request, the district court is to look first to the parties’ contingency- 16 fee agreement, then test it for reasonableness—always respecting “the primacy of lawful attorney- 17 client fee agreements . . . .” Gisbrecht, 535 U.S. at 793 (2002) (noting that courts following this 18 method have “appropriately reduced the attorney’s recovery based on the character of the 19 representation and the results the representative achieved.”). To this end, the Ninth Circuit 20 instructs: 21 A fee resulting from a contingent-fee agreement is unreasonable, and thus subject to reduction by the court, if the attorney provided 22 substandard representation or engaged in dilatory conduct in order to increase the accrued amount of past-due benefits, or if the 23 “benefits are large in comparison to the amount of time counsel spent on the case. [A]s an aid to the court’s assessment of the 24 reasonableness of the fee yielded by the fee agreement,” but “not as a basis for satellite litigation,” the court may require counsel to 25 provide a record of the hours worked and counsel’s regular hourly billing charge for noncontingent cases. The attorney bears the 26 burden of establishing that the fee sought is reasonable. 27 Crawford, 586 F.3d at 1148 (citations omitted). The attorney bears the burden of establishing the 28 reasonableness of the fee. Gisbrecht, 535 U.S. at 807 fn.17. 1 In support of the motion for attorney’s fees under 42 U.S.C. § 406(b), plaintiff’s counsel 2 attached an attorney-client agreement, which provided for a contingent fee of up to 25% of any 3 past due benefits awarded in plaintiff’s case. (ECF No. 32-1.) The Notice of Award indicates 4 plaintiff was awarded $116,347 in past due benefits to plaintiff, 25% of which ($29,086.75) was 5 withheld by the Commissioner for payment of counsel’s fee. (Id. at 2.) Plaintiff’s counsel now 6 seeks a fee of $19,560.00. The Commissioner neither assents nor objects to the fee request, and 7 takes no position on the reasonableness of the request. (ECF No. 34.) 8 In light of the guidance provided in Crawford, the court finds counsel’s fee request here to 9 be reasonable. As an initial matter, agreements providing for fees of 25% of past due benefits are 10 the “most common fee arrangement between attorneys and Social Security claimants.” Crawford, 11 586 F.3d at 1147. Additionally, neither the undersigned nor the Commissioner sees any 12 indication plaintiff’s counsel performed substandard work or unduly delayed the case. To the 13 contrary, counsel’s work over several years ultimately resulted in a favorable decision for 14 plaintiff and an award of substantial benefits. 15 Furthermore, the total amount sought ($19,560.00) does not appear to be disproportionate 16 to the amount of time plaintiff’s counsel spent on the case. Counsel’s billing statement indicates 17 approximately 32.6 hours were dedicated to plaintiff’s case, which equates to a rate of 18 approximately $600 per hour. (ECF No. 32-3.) Counsel did not provide a normal billing rate, but 19 even at this higher rate, the amount requested cannot be said to amount to a windfall to counsel 20 given the guidance in Crawford. See Langston v. Saul, 2020 WL 4501941, at *3 (E.D. Cal. Aug. 21 5, 2020) (awarding fees on an effective hourly rate of $1,453.42, when counsel requested $23,400 22 for 16.10 hours of attorney work); Thomas v. Colvin, 2015 WL 1529331, at *2-3 (E.D. Cal. Apr. 23 3, 2015) (awarding fees on an effective hourly rate of $1,093.22 for 40.8 hours of work); Villa v. 24 Astrue, 2010 WL 118454, at *1-2 (E.D. Cal. Jan. 7, 2010) (awarding fees on an hourly rate 25 exceeding $1,000, where counsel requested $4,569.25 for 5.2 hours of combined attorney and 26 paralegal work, and noting that “[r]educing § 406(b) fees after Crawford is a dicey business”). 27 Further, an hourly rate of almost $600 is not excessive when compared to what the Ninth Circuit 28 Court of Appeals has awarded in Crawford. 586 F.3d at 1153 (J. Clifton, concurring in part and 1 | dissenting in part) (discussing that the majority opinion found reasonable effective hourly rates 2 | equaling $519, $875, $902). Additionally, counsel’s request falls below the 25% maximum 3 | outlined in 42 U.S.C. § 406(b) and in the fee-agreement ($19,560 is approximately 17% of 4 | plaintiff's past due benefits of $116,347). Finally, it is important to note plaintiffs counsel also 5 || assumed the risk of receiving no compensation, as plaintiff's application was denied three times 6 || at the administrative level. (ECF No. 8-3 at 11.) The court finds the fee amount requested is 7 || reasonable in light of the several years of litigation and the result achieved, as well as the lack of 8 | any evidence suggesting either dilatory conduct or a windfall to counsel. 9 For these reasons, the court recommends awarding plaintiffs counsel the requested 10 || amount of $19,560 in attorneys’ fees under 42 U.S.C. § 406(b). This amount would be paid to 11 | plaintiff's counsel, who would then be responsible for reimbursing to plaintiff the previously- 12 || awarded EAJA fees. 13 RECOMMENDATIONS 14 Accordingly, IT IS HEREBY RECOMMENDED that: 15 1. Plaintiff's counsel’s motion for attorney’s fees under 42 U.S.C. § 406(b) (ECF No. 32) be 16 GRANTED, and plaintiff be paid the sum of $19,560.00 from the withheld amounts; and 17 2. Counsel be ordered to reimburse plaintiff $6,500.00 in previously-awarded EAJA fees. 18 These findings and recommendations are submitted to the United States District Judge 19 || assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(1). Within fourteen (14) 20 || days after being served with these findings and recommendations, either party may file written 21 || objections with the court. Such a document should be captioned “Objections to Magistrate 22 || Judge’s Findings and Recommendations.” The parties are advised that failure to file objections 23 || within the specified time may waive the nght to appeal the District Court’s order.
