No. 17) 16 Defendant. 17 18 Pending before the Court is Plaintiff’s motion for attorney fees filed on August 22, 2023. 19 (Doc. No. 17). Plaintiff requests an award attorney’s fees and expenses to Plaintiff’s attorney, 20 Melissa Markos Nyman of Nyman Turkish, PC, in the amount of $8,011.74, and costs in the 21 amount of $402.00, pursuant to the Equal Access to Justice Act (“EAJA”), 28 U.S.C. §§ 1920, 22 2412. (Id.). 23 On August 9, 2023, the Court granted the parties’ Stipulated Motion for Voluntary 24 Remand and remanded the case pursuant to sentence four of 42 U.S.C. § 405(g) to the 25 Commissioner for further administrative proceedings. (Doc. No. 15). Judgment was entered the 26 same day. (Doc. No. 16). Plaintiff now requests an award of fees as the prevailing party. P. 54(d)(1); see 28 U.S.C. § 1920; cf. Shalala v. 2 Schaefer, 509 U.S. 292, 300-02 (1993) (concluding that a party who wins a sentence-four remand 3 order under 42 U.S.C. § 405(g) is a prevailing party). On September 1, 2023, the Commissioner 4 filed a response and does not oppose the amount requested. (Doc. No. 18). 5 The EAJA provides for an award of attorney fees to private litigants who both prevail in 6 civil actions (other than tort) against the United States and timely file a petition for fees. 28 7 U.S.C. § 2412(d)(1)(A). Under the Act, a court shall award attorney fees to the prevailing party 8 unless it finds the government’s position was “substantially justified or that special circumstances 9 make such an award unjust.” Id. Here, the government did not show its position was 10 substantially justified and the Court finds there are not special circumstances that would make an 11 award unjust. 12 Plaintiff requests an award of $8,011.74 in EAJA fees for 33 hours of attorney time and 13 $402.00 in costs. (Doc. No. 17-1). The Court finds an award of $8,011.74 in EAJA fees and 14 $402.00 in costs2 is appropriate. EAJA fees, expenses, and costs are subject to any offsets 15 allowed under the Treasury Offset Program (“TOP”), as discussed in Astrue v. Ratliff, 532 U.S. 16 1192 (2010). If the Commissioner determines upon effectuation of this Order that Plaintiff’s 17 EAJA fees are not subject to any offset allowed under the TOP, the fees shall be delivered or 18 otherwise transmitted to Plaintiff’s counsel. 19 Accordingly, it is RECOMMENDED: 20 1. Plaintiff’s motion for attorney fees and expenses (Doc. No. 17) be GRANTED. 21 2. The Commissioner be directed to pay to Plaintiff as the prevailing party EAJA fees in 22 the amount of $8,011.74 in attorney fees and $402.00 in costs. Unless the Department of 23 Treasury determines that Plaintiff owes a federal debt, the government shall make payment of the 24 fees and costs to Plaintiff’s counsel, Melissa Markos Nyman of Nyman Turkish, PC, in 25 accordance with Plaintiff’s assignment of fees. 26 NOTICE TO PARTIES 27 28 2 Plaintiff paid the filing fee for this action (receipt number ACAEDC-10760403). 1 These findings and recommendations will be submitted to the United States district judge 2 | assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(1).
