The court 19 will therefore recommend that this action be dismissed without prejudice. See Fed. R. Civ. P. 20 16(f); Local Rule 110. 21 In accordance with the above, IT IS HEREBY ORDERED that: 22 1. Defendants are relieved from filing a pretrial statement. 23 2. The pretrial conference set for August 1, 2022, is vacated; and 24 IT IS HEREBY RECOMMENDED that this action be dismissed without prejudice. See 25 Fed. R. Civ. P. 16(f); Local Rule 110. 26 These findings and recommendations are submitted to the United States District Judge 27 assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l). Within fourteen days 28 after being served with these findings and recommendations, any party may file written 1 | objections with the court and serve a copy on all parties.
