MENDOZA, et al., 13 Defendant(s). 14 15 Salvador Venegas (“Plaintiff”) is a state prisoner proceeding pro se and in forma 16 pauperis in this civil rights action filed pursuant to 42 U.S.C. § 1983. 17 On March 15, 2022, the Court issued an order requiring the parties to file scheduling 18 and discovery statements. (ECF No. 35). The parties have now filed their statements. (ECF 19 Nos. 39, 45). 20 The Court has reviewed this case and the parties’ statements. In an effort to secure the 21 just, speedy, and inexpensive disposition of this action,1 the Court will direct that certain 22 documents that are central to the dispute be promptly produced.2 23 24 1 See, e.g., United States v. Each party has sixty days from the date of service of this order to serve opposing 3 parties, or their counsel, if represented, with copies of the following documents 4 and/or evidence that they have in their possession, custody, or control, to the 5 extent the parties have not already done so:3 6 a. Documents regarding exhaustion of Plaintiff’s claims, including 602s, 7 Form 22s, and responses from the appeals office. 8 b. All documents regarding Rules Violation Reports Log Numbers 7056476 9 and 7057242 or any other Rules Violation Report associated with the 10 incident(s) alleged in the complaint, including disciplinary charges and 11 findings. 12 c. Witness statements and evidence that were generated from 13 investigation(s) related to the event(s) at issue in the complaint, such as 14 an investigation stemming from the processing of Plaintiff’s 15 grievance(s).4 16 d. Incident reports regarding the use of force incident(s) alleged in the 17 complaint, including Incident Report Log Number 17207 and 18 photographs of evidence logged. 19 e. All of Plaintiff’s medical records related to the incident and/or condition 20 at issue in the case, including Plaintiff’s Unit Health Record. 21 f. The Court notes that Defendant(s) only need to produce documents such as a Confidential Appeal Inquiry 27 or a Use of Force Critique to the extent those documents contain witness statements related to the incident(s) alleged in the complaint and/or evidence related to the incident(s) alleged in the complaint that will not be 28 provided to Plaintiff separately. 1 the incident(s) alleged in the complaint, including the Administrative 2 Segregation Unit Placement Notice dated January 15, 2021. 3 g. Video recordings and photographs related to the incident(s) at issue in 4 the complaint, including video recordings and photographs of Plaintiff 5 taken following the incident(s), the photographs of Plaintiff and 6 Defendants Mendoza, Cornejo, Grimsley, and Navarro taken on January 7 15, 2021, and the video interview of Plaintiff obtained January 21, 8 2021.5 9 h. Documents identified in Defendants’ scheduling statement, including the 10 Holding Cell Logs dated January 15, 2021; the CDCR form 7219 11 Medical Report of Injury or Unusual Occurrence dated January 15, 2021; 12 Plaintiff’s Central File, including documents concerning felony 13 convictions and Administrative Segregation Placement; Plaintiff’s mail 14 logs; maintenance and repair records from Wasco State Prison, 15 Administrative Segregation Unit; and documents from People v. 16 Venegas, Kern County Superior Court No. DF016243A. 17 2. If any party obtains documents and/or other evidence described above later in 18 the case from a third party, that party shall provide all other parties with copies 19 of the documents and/or evidence within thirty days. 20 3. Parties do not need to produce documents or evidence that they have already 21 produced. 22 4. Parties do not need to produce documents or evidence that were provided to 23 them by the opposing party. 24 5. Parties may object to producing any of the above-listed documents and/or 25 evidence.
