ORDER 13 JOHN MERCHANT,1 14 Respondent. 15 16 Petitioner, a state prisoner proceeding pro se, filed a petition for a writ of habeas corpus 17 pursuant to 28 U.S.C. § 2254. On November 29, 2022, it was recommended that this action be 18 dismissed based on petitioner’s failure to pay the filing fee or file a request to proceed in forma 19 pauperis. On November 29, 2022, petitioner paid the filing fee. On December 15, 2022, 20 petitioner filed objections. Good cause appearing, the findings and recommendations are vacated. 21 Because petitioner may be entitled to relief if the claimed violation of constitutional rights 22 is proved, respondent will be directed to file a response to petitioner’s habeas petition. 23 In accordance with the above, IT IS HEREBY ORDERED that: 24 1.
