ORDER AND FINDINGS & RECOMMENDATIONS 14 RYAN WAKEFIELD, et al., 15 Defendants. 16 17 By order filed January 11, 2024, the complaint was screened and the undersigned found 18 that plaintiff had failed to request relief that could be granted in a § 1983 action and had failed to 19 state a claim for relief against defendant Hernandez. ECF No. 5. Plaintiff was given thirty days 20 to file an amended complaint, and was cautioned that failure to do so would result in a 21 recommendation that this action be dismissed. Id. at 6. Thirty days have now passed, and 22 plaintiff has not filed an amended complaint or otherwise responded to the court’s order. 23 Although it appears from the file that plaintiff’s copy of the order was returned, plaintiff 24 was properly served. It is the plaintiff’s responsibility to keep the court apprised of his current 25 address at all times. Pursuant to Local Rule 182(f), service of documents at the record address of 26 the party is fully effective. 27 Accordingly, IT IS HEREBY ORDERED that the Clerk of the Court shall randomly 28 assign a United States District Judge to this action. ] IT IS FURTHER RECOMMENDED that the complaint be dismissed for failure to state a 2 | claim for the reasons set forth in the January 11, 2024 Screening Order (ECF No. 5). See L.R. 3 || 110; Fed. R. Civ. P. 41(b); 28 U.S.C. § 1915A. 4 These findings and recommendations are submitted to the United States District Judge 5 || assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(1). Within fourteen days 6 || after being served with these findings and recommendations, plaintiff may file written objections 7 || with the court and serve a copy on all parties. Such a document should be captioned “Objections 8 | to Magistrate Judge’s Findings and Recommendations.” Plaintiff is advised that failure to file 9 || objections within the specified time may waive the right to appeal the District Court’s order. 10 || Martinez v.
