SPAIN, 15 Defendant. 16 17 Plaintiff, a prisoner who was proceeding pro se prior to his recent death, filed this civil 18 rights action under 42 U.S.C. § 1983. The matter was referred to a United States Magistrate 19 Judge as provided by Eastern District of California local rules. 20 On June 5, 2024, the Magistrate Judge filed findings and recommendations, which were 21 served on the parties, and which contained notice that the parties may file objections within the 22 time specified therein. No objections to the findings and recommendations have been filed. 23 Although it appears from the file that plaintiff’s copy of the findings and 24 recommendations was returned, plaintiff was properly served. It is the responsibility of plaintiff – 25 or his estate in this instance - to keep the court apprised of his current address at all times. 26 Pursuant to Local Rule 182(f), service of documents at the record address of the party is fully 27 effective. 28 ///// ] The court presumes that any findings of fact are correct. See Orand v. United States, 2 | 602 F.2d 207, 208 (9th Cir. 1979). The magistrate judge’s conclusions of law are reviewed 3 || denovo. See Robbins v. Carey, 481 F.3d 1143, 1147 (9th Cir. 2007) (“[D]eterminations of law 4 | by the magistrate judge are reviewed de novo by both the district court and [the appellate] court 5 || ....”). Having reviewed the file, the court finds the findings and recommendations to be 6 || supported by the record and by the proper analysis. 7 Accordingly, IT IS HEREBY ORDERED as follows: 8 1. The findings and recommendations filed June 5, 2024, ECF No. 40, are 9 || adopted in full. 10 2. Defendant’s motion for judgment on the pleadings, ECF No. 39, is 11 | GRANTED. 12 3. Defendant’s motion for summary judgment, ECF No. 36, is DENIED as 13 || moot. 14 4. This action is DISMISSED in its entirety and with prejudice as moot. 15 5.
