I dissent for the reasons stated in my dissenting opinion in Loving & Evans v. Blick, ante, p. 606 [204 P.2d 23]. In addition I am in accord with the opinion of the District Court of Appeal in affirming the judgment in this case (Second Appellate District, Division 3; 188 P.2d, page 60).
