  • THIS action was brought upon a protested order drawn on the County Treasurer by order of the County Court.

    Mr. Canfield for the County, demurred generally,—The exception under the demurrer was,—That the County is not a corporation in law, capable of suing or being sued.—It has not power to tax itself except in certain cafes expressly pointed out by statute, therefore a judgement against it cannot take effect.
