Mr. Justice Wylie

concurred in the judgment of the court, but expressed the opinion that the evidence of Mrs. Gainey, was competent, and was properly received in the first instance, to show that the mother of the testator was insane. The plaintiff was not, therefore, prejudiced by the direction of the court to disregard it.
