PER CURIAM. We affirm as to all issues except the conviction and sentence for battery. The state
*992 concedes that the trial court failed to instruct the jury as to the elements of the crime of battery. We therefore reverse and remand for a new trial on that issue.GUNTHER, WARNER and FARMER, JJ., concur.
