    concurring.

    In my dissent to the denial of appellee’s motion to dismiss, I explained why I believe this matter is moot (Perdue v. Baker, 276 Ga. 822 (586 SE2d 303) (2003)), and I adhere to that belief. However, the denial of the motion to dismiss establishes as the law of the case that the matter is not moot. That being so, I concur in the affirmance of *16the judgment below.
