Hill, C. J. The Supreme Court and this court have uniformly held that the discretion of the judge of the superior court in granting a first new trial on certiorari will not be interfered with, unless the judgment under review was demanded by the law and the evidence. Loftin v. Great Southern Some Benevolent Asso., 9 Ga. App. 121 (70 S. E. 353), and citations; 14 Encyc. Dig. Ga. Rep. 364. Judgment affirmed.
