The rulings in Moody v. Foster, 74 Ga. App. 829, are controlling on the issues presented in the present case, and the superior court erred in sustaining the defendant's general demurrer and in dismissing the petition.

Judgment reversed. Broyles, C. J., and Gardner, J.,concur.
