Subsequently, at the March term, 1892, upon a rehearing, the court filed this further opinion:

Per Curiam :

Having again considered the questions discussed in this case on a rehearing, we have arrived at the conclusion that our former views, as indicated by the opinion filed, are, substantially, correct and we therefore now refile that opinion as the opinion of the court and affirm the judgment in part and reverse it in part as therein indicated.
