The questions presented by this appeal are identical with those in Mutual Mfg. Co. v. Alpaugh (1910), ante, 381, and upon the authority of that case the judgment is reversed, with instructions to the court below to sustain the demurrer to the plea in abatement, and for further proceedings not inconsistent with this opinion.
