Chicago, Indianapolis & Louisville Railway Co. v. Tackett ( 1904 )

Menu:
  • Wiley, J.,

I concur in the conclusion reached, but entertaining some doubt as to the correctness of the instruction on the duty of a master to furnish reasonably safe tools, appliances, etc., with which his servant is to work, instead of stating to the jury that it is the duty of the master to use reasonable care in furnishing such tools and appliances, I do not feel like giving my assent to the instruction as given.
