Coe v. Security National Insurance ( 1980 )

  • Herd, J.

dissenting: I respectfully dissent from the majority opinion. I would calculate the anticipated annual earnings of an unemployed person by adding together the years of annual compensation and dividing it by the number of years employed not to exceed five (5). In this case, I would use the annual income for the years 1970, 1971 and 1972 and divide by three producing an average annual compensation of $5,490.95. Also, I would award interest on the amount owed from the date of the accident at 18%.
