Petitioner is granted an evi-dentiary hearing to determine whether a motion to appeal his conviction was filed, whether he was advised of his right to appeal, whether he waived the right to appeal, etc. Counsel should be appointed to represent applicant at this hearing upon satisfactory showing that he is indigent.
