I wish that I were able to concur in the result in this case, but I can find no legal support for that result. The judgment of the trial court against the three royalty owners who failed to appeal is res judicata as to them: For the reasons assigned by the’Court-of Appeal in-Fontenot v. Sun Oil Go:;"240 So.2d 924 (La.App.3rd Cir. 1970), I’- respectfully dissent.
