BEER, Judge, concurring.
Prison breaks, by their very nature, demand swift and unequivocal response. Indeed, some excesses in immediately responding to such incidents are understandable. But, here, in my view, the beating was unrelated to the actual recapturing of the escapees and was in direct retaliation for attempting to escape.
Since the record can, however, support contrary findings, I concur.
