concurring.

I concur in the result reached by the majority for the reasons stated in their opinion. However, I believe the legislature never intended La. R.S. 9:402 to be used by parents to escape their obligation to support, comfort and care for a child.

The best interests of the child should be considered by the courts in situations of this type. But, as pointed out by the majority, this is a problem, to be solved by the legislature, not the courts.
