concurs in part and dissents in part.

I concur with the majority opinion on all but one issue. I am opposed to assessing any costs to the appellees. I believe it is unconstitutional to charge a prevailing or successful party in an appeal with costs of the proceedings. I would, therefore, tax Mr. and Mrs. Charles with all costs.
