I respectfully dissent. Given the facts presented at the hearing on the motion for summary judgment, I find there is a genuine issue as to whether the employees were using the vehicle at the time of the accident. I would reverse the judgment of the trial court finding coverage in the commercial automobile liability policy and the commercial umbrella policy, and remand for a trial.
